These Terms of Use (“Terms”) apply to the services provided by Ekivera : the ekivera.com web application and the Ekivera iOS/Android mobile applications (together, the “Platform”). By creating an account or using the Platform, you are deemed to have accepted these Terms.
1. Description of the service
Ekivera is a multi-tenant SaaS platform that field service businesses use to manage customer requests, site surveys, quotes, work orders, teams, contracts, invoices, and collections. The service is provided “as is,” and we reserve the right to add, change, or remove features over time.
2. Account and responsibilities
- You are responsible for the accuracy and confidentiality of your account information.
- The business that creates the account is responsible for the actions of the users (managers, staff, portal customers) opened under that business account.
- All actions carried out through your account are deemed to be yours; if you notice suspicious access, you must change your password immediately and notify us.
3. Subscription, payment, and cancellation
- The Platform is offered with a free trial period and paid subscription plans. Current plans and prices are published on our pricing page .
- In-app subscriptions: Subscriptions started through the mobile app are billed through your Apple App Store or Google Play account and are subject to that store's terms. Subscriptions renew automaticallyunless canceled at least 24 hours before the end of the current period; the renewal fee is charged to your store account within 24 hours before the period ends.
- Canceling and managing store subscriptions is done through the subscription settings of the store where the purchase was made (App Store: Settings → Subscriptions; Google Play: Payments & subscriptions). Cancellation takes effect at the end of the current period; partial-period refunds are subject to the store's policies.
- If you do not move to a paid plan at the end of the trial period, your account may be kept with limited functionality or in read-only mode.
4. Acceptable use
While using the Platform, you agree not to:
- Enter content that is unlawful, misleading, or infringes the rights of third parties,
- Send unauthorized commercial electronic messages (unsolicited SMS/email/WhatsApp),
- Test the Platform's security, reverse-engineer it, or disrupt the service,
- Attempt unauthorized access to another user's account,
- Use the Platform to distribute malicious software.
5. Data ownership and privacy
- Business data belongs to the business. You own the customer, job, and financial records you enter into the Platform; Ekivera processes this data only to provide the service.
- Details on the processing of personal data are set out in our Privacy Policy and KVKK Disclosure Notice, which forms an integral part of these Terms.
- You can delete your account from within the app at any time; deletion cannot be undone.
6. Intellectual property
The Platform's software, design, brand, and all components belong to Ekivera. Your subscription only grants you the right to use the service; copying, distributing, or using the source code, design, or brand in derivative works is prohibited.
7. Limitation of liability
- Ekivera makes commercially reasonable efforts to provide the service without interruption or error; however, planned maintenance and outages beyond our control may occur.
- Ekivera cannot be held liable for indirect damages, user errors in data entry, the relationships between businesses and their own customers, or outages of third-party services (stores, notification providers).
- In all cases, our total liability is limited to the subscription fees you paid to Ekivera in the 12 months preceding the event giving rise to the claim.
8. Suspension and termination
- In the event of a breach of these Terms, we may suspend or terminate your account with prior notice (immediately for serious breaches).
- You can close your account at any time; your data is deleted in line with the periods set out in our Privacy Policy.
9. Changes
You will be notified through the Platform whenever a material change is made to these Terms; continuing to use the Platform after a change means you accept the updated Terms.
10. Governing law and contact
These Terms are governed by the laws of the Republic of Turkey; the Istanbul (Anatolian) Courts and Enforcement Offices have jurisdiction over disputes. For questions, you can write to destek@ekivera.com .
